To prove the transfer is a genuine gift and not a taxable sale, both the donor and the recipient must complete the Sworn Statement for a Family Gift of a Used Motor Vehicle in the Province of Ontario.
According to the Ministry of Finance, an eligible family member includes a:

Parent or Step-parent
Child or Step-child
Grandparent or Grandchild
Sibling (Brother/Sister)

Yes. Because both the person giving the vehicle and the person receiving it must swear an oath and sign the form, both parties must be present in front of the Commissioner of Oaths. If you cannot be in the same room, you can both join a virtual commissioning video call from different locations.

No. You must sign the affidavit in the presence of the commissioner (either virtually on camera or in-person). Signing beforehand invalidates the document, and you will have to fill out a new one.
Both the donor and the recipient must present one valid, unexpired piece of government-issued photo ID. Accepted forms of ID include an Ontario Driver’s License, Passport, Canadian Permanent Resident Card, or Ontario Photo Card.
