    Virtual Commissioning and Remote Witnessing Laws in British Columbia

    British Columbia has implemented legislation and guidelines that allow for the remote commissioning and witnessing of certain legal documents via audio-visual technology. These measures enhance accessibility and efficiency in legal processes across the province.

    • Electronic Wills: As of December 1, 2021, British Columbia recognizes electronic wills, allowing them to be created, signed, witnessed, and stored entirely digitally.
    • Remote Witnessing of Wills: Wills can be witnessed remotely via video conferencing, provided that at least one witness is a lawyer or notary public. All parties must sign complete and identical copies of the will in counterpart, and the will must include a statement indicating it was signed and witnessed in accordance with the applicable legislation. 
    • Enduring Powers of Attorney (EPAs) and Representation Agreements (RAs): While EPAs and RAs must still be signed with wet ink, they can be witnessed remotely via video conferencing if the witness is a lawyer or notary public. The document must state that it was signed and witnessed in accordance with the applicable ministerial order. 
    • Land Title Documents: The Land Title and Survey Authority (LTSA) permits remote witnessing of land title documents under certain conditions, such as when executed under an enduring power of attorney. A lawyer or notary public must complete a Section 49 affidavit of execution to accompany the remotely witnessed document. 
      • Viewing valid, current government-issued photo identification.
      • Comparing the ID photo with the signer during the video session.
      • Recording the date and method of verification.
      • Treating the transaction as high risk and monitoring accordingly.
      • Documenting the efforts made to verify the client’s identity and the reasons for using remote verification.Identity Verification: Lawyers must verify the signer’s identity by:
    • Real-Time Video Required: All remote witnessing or commissioning must occur in real time with clear audio and visual communication, ensuring all parties can see, hear, and communicate with each other throughout the process. 
    • Technology Access: Participants must have access to the necessary technology (e.g., camera, microphone, internet connection) to facilitate the remote process effectively.
    • Lawyer Compliance: Lawyers must adhere to the guidelines set out by the Law Society of British Columbia, including maintaining records and completing any required declarations when performing remote legal services.

Full-time students are required to present a valid student ID along with proof of current full-time enrollment. Seniors must be 65 years of age or older and show government-issued ID for age verification. Those receiving social assistance must provide official documentation from either Ontario Works or the Ontario Disability Support Program (ODSP). Canadian military personnel must present valid military identification. All submitted documentation must be current and verifiable. Canada Notary reserves the right to decline the discount if sufficient proof is not provided.
