    Virtual Commissioning and Remote Witnessing Laws in Nunavut

    Unlike some provinces, Nunavut has not adopted permanent rules for remote witnessing or virtual commissioning of documents.

    Here’s an overview of the current legal landscape:

    Wills and Witnessing

    • Under the Nunavut Wills Act, a will must be in writing and signed with wet ink in the presence of two witnesses physically present at the same time.
    • There are no provisions allowing remote witnessing or electronic wills at this time.

    Holograph (Handwritten) Wills

    • You may create a holograph will by writing it entirely by hand and signing it yourself — no witnesses are required.
    • Partial handwritten wills may still be valid under “substantial compliance” but can be subject to court interpretation.

    Powers of Attorney, Affidavits, and Statutory Declarations

    • The Evidence Act allows lawyers and authorized notaries to commission affidavits and declarations, but these must be done in person.
    • Remote commissioning or witnessing by video call is not currently permitted in Nunavut.

    Electronic Documents and Signatures

    • The Electronic Commerce Act allows electronic signatures for some transactions.
