What Small Claims Forms Require Commissioning?

In the Ontario Small Claims Court, whenever you need to prove that an action was taken (like serving a document) or present evidence to a judge without a witness testifying in person, you must use a sworn affidavit.

Our licensed commissioners routinely swear all types of Small Claims Court forms, including:

  • Form 8A: Affidavit of Service – Proves to the court that you successfully delivered your Plaintiff’s Claim or Defence to the other party.

  • Form 11A: Affidavit for Jurisdiction – Used when requesting a default judgment to prove the claim was filed in the correct courthouse.

  • Form 15A: Notice of Motion and Supporting Affidavit – Required when asking a judge to make a specific order before the trial.

  • Form 15B: Affidavit (General) – Used to submit general written evidence for motions and hearings.

  • Form 20M: Affidavit of Default Payment – Sworn to prove that a debtor failed to make a payment ordered by the court.

Having these documents sworn and signed by an official notary public or commissioner of oaths provides legally binding proof of your statements, keeping your lawsuit moving forward.

Book an appointment at one of our physical Ontario locations, or choose our fast and secure online commissioning service to swear your oath via video call. We also offer mobile notary services to visit your office.

Verify ID & Swear Oath

Present valid government-issued photo ID to our commissioner, declare that the contents of your forms and exhibits are true, and sign the documents. We will immediately apply our official seal and signature so you can file them at the courthouse or via the Small Claims Court Submissions Online portal.

Yes! If your Affidavit (like Form 15B) relies on business records, invoices, or contracts, we can stamp and commission those documents as official exhibits during your appointment.

No. Commissioners of Oaths and Notaries Public can legally verify your identity, administer an oath, and sign your affidavit, but we cannot provide legal advice or instruct you on how to fill out the contents of your claim. If you need legal strategy, we recommend consulting a paralegal or lawyer.

You must present one valid, unexpired piece of government-issued photo ID. Accepted forms of ID include an Ontario Driver’s License, Passport, Canadian Permanent Resident Card, or Ontario Photo Card.
