What are CCDC 9A and 9B?

CCDC 9A is the Statutory Declaration of Progress Payment Distribution by Contractor. The contractor declares that everything payable from the previous payment has been paid, apart from holdback, amounts deferred by agreement and amounts withheld because of a communicated dispute. It’s commonly a condition of the next progress payment or of holdback release.

CCDC 9B is the same declaration made by a subcontractor to the contractor. Both are declared before a Commissioner for Taking Affidavits, Notary Public or Justice of the Peace.

Download the 2018 forms free from CCDC. A purchased CCDC 9 copyright seal must be attached before the form is declared. 2001 seals can’t be used on the 2018 forms.

The officer declares the statement is true and signs in front of our commissioner, who completes the jurat.

What to bring

  • The CCDC 9A or 9B, completed and unsigned
  • The CCDC 9 copyright seal (2018) already attached
  • Photo ID of the signing officer
  • Your title, for example President or authorized officer

Avoid these common mistakes

  • Forgetting the copyright seal. Without it the form may be rejected.
  • Using an old 2001 seal on a 2018 form.
  • Signing before the appointment.
  • The wrong person signing. It should be an officer authorized to sign for the company.

Frequently asked questions

Can you supply the copyright seal?

No. Seals are sold through CCDC’s document outlets. Please buy one before your appointment.

Can I get several declarations done at once?

Yes. Our per-document pricing drops for additional documents, which is helpful for monthly draws on multiple projects.

Can it be done by video?

Ontario allows remote commissioning by live video. Check that your owner or GC accepts a remotely commissioned declaration first.

Is this the same as a statutory declaration of completion?

No. Other construction declarations exist. Bring whatever form your owner or GC requested and we’ll commission it.
