The "Family Gift" Affidavit (Form 1157E)

The Sworn Statement for a Family Gift of a Used Motor Vehicle in the Province of Ontario is a government form that certifies the vehicle is being given for free (no money exchanged) to an eligible family member.

Because this form exempts the government from collecting tax revenue, they are strict about it. The form must be commissioned (signed and stamped) by a Notary Public or Commissioner of Oaths before you visit the licensing office.

Who is Eligible for the Tax Exemption?

According to Service Ontario guidelines, you can transfer a vehicle tax-free to the following family members:

  • Spouse (Married or Common-Law)

  • Parent or Step-Parent

  • Grandparent or Step-Grandparent

  • Child or Step-Child

  • Grandchild or Step-Grandchild

  • Sibling (Brother/Sister, including Half-Siblings and Adopted Siblings)

  • In-Laws (Mother/Father-in-Law, Son/Daughter-in-Law)

Who is NOT Eligible: You generally cannot gift a vehicle tax-free to a cousin, aunt, uncle, niece, or nephew. For these transfers, you may need a standard Bill of Sale and an appraisal.

Fill It Out (But Do Not Sign)

Enter the VIN, Make, Model, and both parties’ addresses. Do not sign the bottom yet.

Visit Us

Bring the form and your valid Photo ID to one of our [Walk-In Locations].

Sign & Stamp

We will witness your signature and apply the Commissioner stamp.

Go to Service Ontario

Take the stamped form, the Used Vehicle Information Package (UVIP), and proof of insurance to finalize the transfer.

Frequently Asked Questions (FAQ)

Ideally, yes. Both signatures are required on the form. If you cannot come together, the Donor can sign in front of us first, and the Recipient can sign later (or vice versa), but it is faster if you appear together.
