By accessing, browsing, or using our services—whether in person at one of our offices, online through our digital platforms, or via our mobile notary appointments—you explicitly agree to be bound by the following Terms and Conditions (the “Agreement”).

1. Acceptance of Terms

By engaging with Canada Notary, you acknowledge that you have read, understood, and voluntarily agreed to be bound by these Terms.

  • Mandatory Agreement: If you do not agree with any part of these Terms, you are prohibited from using our services.

  • Updates: Canada Notary reserves the right to amend, modify, or update these Terms at any time without prior notice to reflect changes in legal regulations or business operations.

  • Continued Use: Your continued use of our services following the posting of any changes constitutes your acceptance of those changes. It is your responsibility to review this page periodically for updates.

2. Scope of Services

Canada Notary is a premier provider of legal document verification services. Our offerings include, but are not limited to:

  • Notarization and Commissioning of Oaths.

  • Certified True Copies of original documents.

  • Affidavits and Statutory Declarations.

  • Authentication and Legalization (Apostille) services for international use.

  • Certified Translation services.

  • Mobile Notary (we come to you) and Virtual Remote Commissioning.

Important Legal Disclaimer: While our team includes licensed legal professionals, our role in this capacity is strictly limited to the verification of identities and the witnessing of signatures. We do not provide legal advice regarding the content or consequences of your documents unless you have specifically retained us for legal counsel under a separate retainer agreement. Clients are solely responsible for ensuring their documents are legally legally sound and appropriate for their intended purpose.

3. Virtual Client Service Agreement (Online, Apostille & Translation)

3.1. Non-Location Based Engagement

By hiring Canada Notary for a virtual service, you acknowledge that the entire transaction is being conducted remotely. You explicitly confirm that:

  • You have not physically visited any of Canada Notary’s brick-and-mortar office locations.

  • You have not interacted with our front-desk staff at a physical location.

  • Your service experience is entirely digital and unrelated to the operations of our physical branches.

3.2. Prohibition on Location-Based Reviews

To maintain the integrity of our public feedback systems, clients who have not physically visited a location are strictly prohibited from posting reviews on location-specific platforms.

  • Prohibited Actions: You agree NOT to post reviews, ratings, photos, or feedback on Google Business Profiles, Yelp, Yellow Pages, or other directory listings associated with our physical offices (e.g., “Canada Notary – Brampton” or “Canada Notary – Toronto”).

  • Misrepresentation: Posting a review on a physical location profile when you were a virtual client constitutes a misrepresentation of the consumer experience. It serves to mislead future local clients and is considered a material breach of this Agreement.

  • Authorized Channels: If you wish to provide feedback on your virtual experience, please direct it to our management team via email or through specific channels provided for virtual clients.

3.3. KYC (Know Your Client) & Identity Verification

The integrity of the notary process relies on strict identity verification.

  • Warrant of Truth: You warrant that all identification, video feeds, and information submitted to us are authentic, current, and accurate.

  • Fraud Prevention: Any attempt to use a fake identity, doctored documents, or an imposter during a video call will result in immediate termination of the session, forfeiture of fees, and potential reporting to relevant authorities.

4. Client Responsibilities

To ensure a smooth appointment, you agree to the following responsibilities:

  • Preparation: You must arrive (or log in) on time with all necessary documents printed (unless digital signing is agreed upon) and unsigned.

  • Valid ID: You must present valid, government-issued photo identification (e.g., Passport, Driver’s License, PR Card). Expired ID will not be accepted.

  • Professional Conduct: We maintain a zero-tolerance policy for abuse. Any client who exhibits aggressive, threatening, harassing, or defamatory behavior—whether in person, over the phone, or online—will be refused service immediately. This includes “review bombing” or threatening negative reviews to extort services or refunds.

5. Payments, Fees, and Refund Policy

5.1. Payment Terms

All fees are due immediately upon the provision of service. For online and mobile services, prepayment may be required to secure your appointment slot.

  • Transparency: We strive to keep our pricing competitive and transparent. Any additional costs for travel, expedited service, or complex drafting will be communicated to you before work begins.

5.2. Refund Policy

  • Services Rendered: Once a service has been performed (e.g., the seal has been applied, or the draft has been written), no refunds will be issued.

  • Cancellations: If you cancel an appointment with sufficient notice (typically 24 hours), a refund or credit may be issued at our discretion.

  • Errors: In the rare event of an error made by our staff, we will redo the document free of charge. However, we are not responsible for errors contained within the document you provided.

6. Appointments, Delays, and Cancellations

We value your time and ask that you value ours.

  • Punctuality: If you are late for your appointment, we may need to shorten your session or reschedule you to avoid delaying other clients. Late fees may apply.

  • Unforeseen Delays: While we aim for perfection, factors outside our control (such as government processing times for Apostilles, courier delays, or technical internet issues) may impact timelines. Canada Notary accepts no liability for delays caused by third parties or “Force Majeure” events.

7. Document Accuracy and Legal Use

  • Verification Limits: Our responsibility is to verify that you are who you say you are and that you signed the document voluntarily. We do not verify the truthfulness of the statements inside your document.

  • Prohibited Use: You agree not to use our services for any fraudulent, illegal, or deceptive purpose. If we suspect a document is being used for fraud, we reserve the right to refuse notarization and note the refusal in our records.

  • Client Liability: You assume full legal liability for the content of your documents and the consequences of their use.

8. Social Media, Non-Disparagement & Economic Loss

This section protects our business from unfair damage caused by online defamation.

8.1. Dispute Resolution First

If you are dissatisfied with our service, you agree to contact Canada Notary management directly to seek a resolution. We are committed to fixing legitimate issues and ensuring client satisfaction.

8.2. Business Defamation & Economic Loss

You agree that you will not publish, post, or distribute any disparaging, defamatory, false, or misleading comments regarding Canada Notary, its employees, or its services on any public platform (including Google Reviews, Social Media, Trustpilot, etc.).

  • Breach of Contract: Violating this clause—specifically by posting negative reviews on location profiles you never visited—is a breach of contract.

  • Liability for Damages: You acknowledge that negative reviews can cause significant financial harm to a business. In the event of a breach, you agree that you may be held liable for civil damages for business defamation and economic loss (lost revenue).

  • Enforcement: Upon notification of a breach, you agree to remove the offending content immediately (within 24 hours). Failure to do so may result in legal action to recover damages and legal costs.

9. Limitation of Liability

To the fullest extent permitted by law, Canada Notary shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services.

  • Cap on Liability: Our total liability to you for any claim arising out of our services is strictly limited to the amount you paid for that specific service.

  • No Third-Party Liability: We are not responsible if a third party (such as a foreign consulate or bank) rejects your document for reasons unrelated to our notarization.

10. Privacy and Confidentiality

Your privacy is paramount.

  • Data Usage: We collect only the personal information necessary to perform the requested service and to comply with our record-keeping obligations under the Commissioners for Taking Affidavits Act.

  • Protection: We maintain strict security protocols to protect your documents and data. We do not sell your information to third parties.

11. Governing Law

These Terms and Conditions constitute a legally binding contract governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.

  • Jurisdiction: By using our services, you consent to the exclusive jurisdiction of the courts located in Ontario for the resolution of any disputes.

  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

Discount Eligibility

Terms & Conditions

To qualify for the 15% notary discount, eligible individuals must provide valid proof. Full-time students are required to present a valid student ID along with proof of current full-time enrollment. Seniors must be 65 years of age or older and show government-issued ID for age verification. Those receiving social assistance must provide official documentation from either Ontario Works or the Ontario Disability Support Program (ODSP). Canadian military personnel must present valid military identification. All submitted documentation must be current and verifiable. Canada Notary reserves the right to decline the discount if sufficient proof is not provided.
