These Terms are intended to protect both our clients and our business operations, while ensuring that we can continue to provide professional, reliable, and affordable notary services across Canada.
By using Canada Notary’s services, you acknowledge that you have read, understood, and agreed to these Terms and Conditions. If you do not agree with any part of these Terms, you must refrain from using our services. Continued use of our services constitutes your acceptance of any updates or modifications to these Terms.
Canada Notary reserves the right to amend, modify, or update these Terms at any time without prior notice. Clients are encouraged to review this page periodically. Any changes will take immediate effect upon posting, and your continued use of our services after such modifications indicates your acceptance of the revised Terms.
Canada Notary provides a wide range of services including notarization, commissioning, certified true copies, affidavits, statutory declarations, authentication and legalization, apostille, translation, and other document-related services. We also offer mobile notary and virtual notary services depending on the client’s needs and jurisdictional requirements.
While we make every effort to ensure accuracy and compliance with applicable laws, Canada Notary does not provide legal advice unless expressly stated. Clients are responsible for ensuring that the documents they present for notarization or commissioning are complete, accurate, and legally appropriate for their intended purpose.
Clients are expected to provide accurate information, valid identification, and all necessary supporting documents at the time of service. Failure to do so may result in delays, additional fees, or refusal of service. It is the client’s responsibility to verify the specific requirements of their documents for use in foreign or domestic jurisdictions.
Clients must also treat all Canada Notary staff with professionalism and respect. Abusive, threatening, or defamatory behavior—including but not limited to verbal harassment, online slander, or unfair public reviews—will not be tolerated. Canada Notary reserves the right to discontinue services and pursue legal remedies in cases of client misconduct.
All fees for services are due at the time of service unless otherwise agreed in writing. Canada Notary strives to provide competitive pricing and transparency in all service charges. A full list of standard fees is available upon request, though additional fees may apply for expedited services, mobile notary requests, or complex document processing.
Payments must be made using approved payment methods. Canada Notary reserves the right to withhold documents or refuse future services until outstanding balances are settled. Refunds are not provided once services have been rendered, except at Canada Notary’s sole discretion in exceptional circumstances.
Clients are responsible for booking appointments in advance and arriving on time. Late arrivals may result in shortened appointments, rescheduling, or additional charges. If you anticipate a delay, you must notify our office as soon as possible to avoid disruptions to other scheduled clients.
While Canada Notary will make every effort to honor scheduled appointments, unforeseen circumstances such as technical issues, staff availability, or third-party delays (e.g., government offices or couriers) may affect service timelines. Canada Notary shall not be held liable for delays beyond our control, though we will communicate updates and offer reasonable alternatives whenever possible.
Canada Notary is responsible solely for verifying identity, witnessing signatures, and certifying documents as true copies where applicable. We do not guarantee the validity, enforceability, or acceptance of any document by third parties, institutions, or foreign authorities. Clients must confirm the requirements of the receiving party before proceeding with notarization.
Any misuse of notarized documents, fraudulent declarations, or misrepresentations by the client are strictly prohibited. Canada Notary disclaims any liability arising from the client’s use of notarized documents for unlawful or fraudulent purposes. Clients may be held legally responsible for any false statements or misuses of notarized materials.
Clients agree to resolve disputes or service concerns directly with Canada Notary before posting public reviews, complaints, or commentary online. Posting false, misleading, defamatory, or damaging content on social media, review platforms, or any public forum is considered a breach of these Terms. Canada Notary reserves the right to take legal action in response to defamatory statements that harm our reputation or business operations.
We welcome constructive feedback and are committed to addressing legitimate concerns in a timely manner. However, clients who engage in public misconduct, including posting false claims or inciting negative campaigns, may be subject to service termination, claims for damages, and recovery of costs associated with reputational harm.
Canada Notary shall not be held liable for indirect, incidental, or consequential damages arising from the use of our services. Our liability is strictly limited to the amount paid by the client for the specific service in question. We do not assume responsibility for losses related to delays, third-party actions, rejected documents, or failures caused by circumstances outside our direct control.
While we make every effort to ensure professionalism, accuracy, and timely delivery of services, clients acknowledge that notarial services are limited in scope and subject to applicable laws and regulations. Clients assume full responsibility for the ultimate use, acceptance, and legal impact of their notarized documents.
Canada Notary values the privacy of our clients. Any personal information collected during the course of providing services will be handled in accordance with our Privacy Policy. Information will only be used for service delivery, verification, and compliance with applicable laws.
We maintain strict confidentiality of client documents and information, except where disclosure is required by law or client consent is given. Clients are encouraged to review our Privacy Policy for further details on how personal data is collected, stored, and safeguarded.
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein. By using our services, you agree that any disputes shall be resolved exclusively in the courts of Ontario.
Should any provision of these Terms be deemed unenforceable, the remaining provisions shall remain in full force and effect. These Terms constitute the entire agreement between Canada Notary and the client, superseding any prior agreements or understandings, whether written or oral.

We follow the Law Society of Ontario’s guidelines regarding remote and virtual signing under the Commissioners for Taking Affidavits Act and the witnessing of wills under the Succession Law Reform Act, provided all required conditions are met. Online notary services are not permitted under the Notaries Act. Contact us for more information or to determine if your matter qualifies.

Terms & Conditions
